All the crimes committed by drivers "caught" at over 200 km/h in a 2-second interval in Navarra

In Spain, there are still drivers who think the road is a Formula 1 track, making dangerous overtaking maneuvers or traveling at high speeds. This is the case of two cars intercepted by a speed camera on the AP-68 near Tudela (Navarra) just two seconds apart on Monday, May 12.

First, a SEAT León was "caught" at 202 km/h at 8:44:20 , and immediately after, at 8:44:21, a Citroën C4 was caught at 195 km/h by the same device. Therefore, the Navarra Regional Police are already investigating what happened as a suspected illegal race .

What crimes are both cars committing?

First, the alleged illegal race could be investigated for the commission of a crime against road safety, as defined in Article 380 of the Penal Code , which specifies: "Anyone who drives a motor vehicle or moped with manifest recklessness and specifically endangers the life or integrity of persons."

The driver of the SEAT León will be investigated for an offense classified under Article 379 for driving "a motor vehicle or moped at a speed exceeding sixty kilometers per hour on urban roads or eighty kilometers per hour on interurban roads, the speed limit." He was intercepted at 202 km/h, and the maximum speed limit on highways is 120 km/h. The Citroën driver will be fined only administratively .

What penalty does each crime provide?

In the case of the crime of reckless driving (Article 380), both drivers may be punished "with prison sentences of six months to two years and deprivation of the right to drive motor vehicles and mopeds for a period of more than one and up to six years."

For its part, the crime of exceeding the maximum speed by 80 km/h (art. 379) establishes a "penalty of imprisonment of three to six months or a fine of six to twelve months or community service of thirty-one to ninety days, and, in any case, with deprivation of the right to drive motor vehicles and mopeds for a period of more than one and up to four years."

Speeding fines and points deducted: How do they increase?

The DGT applies sanctions in accordance with Table 1 of Annex IV of the Traffic Law , which details both the fines and the number of points deducted from the license based on the speed limit for each road . In the specific case of motorways with a speed limit of 120 km/h, where the alleged "illegal race" occurred in Navarre, the following ranges of sanctions and points deductions are contemplated:

  • 121 to 150 km/h : 100 euro fine and zero points.
  • 151 to 170 km/h : 300 euros and two points.
  • 171 to 180 km/h : 400 euros and four points.
  • 181 to 190 km/h : 500 euros and six points.
  • Over 191 km/h : 600 euros and six points, and over 200 km/h constitutes a road safety offense.
